1. AGREEMENT TO TERMS
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Client,” “You”), and ICT Projections LLC, doing business as Walk Your Plans Wichita (“Company,” “We,” “Us,” or “Our”), located at 5160 N Webb Rd, Bel Aire, KS 67226.

By booking a session, purchasing a subscription, or entering our facility, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions.

2. NATURE OF SERVICES & DISCLAIMER
2.1 Visualization Only. The Company provides 1:1 scale floor plan projection services for visualization purposes only. We are not architects, engineers, or general contractors.
2.2 No Professional Advice. The projections provided are strictly for conceptualization. They do not constitute architectural or engineering advice. You acknowledge that any construction, design, or structural decisions made based on these projections are your sole responsibility.
2.3 Accuracy of Files. The accuracy of the projection is dependent on the quality and scale of the digital files provided by the Client. The Company is not responsible for errors inherent in the Client’s source files (PDF, CAD, etc.).
2.4 Not a Construction Contract. The Parties agree that this Agreement is for visualization services only and does not constitute a “construction contract” as defined by K.S.A. 16-121. Consequently, the indemnification provisions herein shall be interpreted to the fullest extent permitted by Kansas law, separate from statutory restrictions on construction liability.

3. BOOKING, PAYMENT, AND CANCELLATION
3.1 Payment Terms. Full payment is required at the time of booking for hourly sessions. Subscription Clients (Standard/Professional tiers) will be billed monthly in advance via the credit card on file.
3.2 Pricing. Hourly Rate: $995.00 per hour. Subscriptions: Governed by the specific Subscription Agreement signed at onboarding.
3.3 Zero Refund Policy. All sales are final. The Company maintains a strict no-refund policy for all bookings, service retainers, and subscription payments. We do not provide cash refunds for cancellations under any circumstances.
3.4 Rescheduling. Notice Required: We understand schedules change. You may reschedule your session for a future date without penalty, provided you notify us at least 24 hours prior to the original scheduled start time. Forfeiture: Rescheduling requests made less than 24 hours in advance, or failure to arrive by the start time of the session (“No-Show”), result in immediate forfeiture of the session and all funds paid. Credits will not be applied to future bookings in these instances.

4. INTELLECTUAL PROPERTY RIGHTS
4.1 Licensor Rights. The proprietary system, software, and methods used to project the plans are the intellectual property of Walk Your Plans LLC (the “Licensor”) and are used by the Company under an exclusive license. You agree not to reverse engineer, copy, or attempt to replicate the proprietary projection system.
4.2 Client Data. You retain all ownership rights to the architectural plans, blueprints, and documents you upload or bring to the facility. You grant Us a limited license to use these files solely for the purpose of the projection session.
4.3 Commercial Media Release. You grant the Company an irrevocable, royalty-free, worldwide license to use your name, likeness, and image (and that of your guests/employees) captured during the session for advertising, trade, and promotion of the Company’s services. You waive any right to inspect or approve the finished product and release the Company from any liability for “misappropriation of personality” or “right of publicity” under Kansas law. If you require privacy (e.g., for secure government or legal projects), you must execute a separate Non-Disclosure Agreement (NDA) prior to the session.

5. FACILITY USE AND CONDUCT
5.1 Safety. You agree to follow all safety instructions provided by Company staff. You are responsible for the conduct of all guests or colleagues accompanying you.
5.2 Damage to Equipment. Our facility utilizes high-value Panasonic projection hardware. You agree to be financially liable for any damage to the facility, floor, or equipment caused by the negligence or willful misconduct of you or your party.
5.3 Prohibited Items. In accordance with our premises lease, no hazardous materials, flammable liquids, or unapproved heavy machinery may be brought into the facility.

6. INDEMNIFICATION AND LIMITATION OF LIABILITY
6.1 Indemnification. You agree to defend, indemnify, and hold harmless ICT Projections LLC, Walk Your Plans LLC, and their respective owners, officers, and employees from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, arising out of your use of the services or the facility.
6.2 Limitation of Liability. In no event will the Company be liable to you for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits or construction change order costs, arising from your use of the service.
6.3 Liability Cap. Our liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to the Company for the specific session during which the cause of action arose.

7. GOVERNING LAW
These Terms shall be governed by and defined following the laws of the State of Kansas. You irrevocably consent that the courts of Sedgwick County, Kansas shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

8. FORCE MAJEURE
The Company shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout, or interruption or failure of electricity or telephone service. In such an event, the Company’s sole obligation is to reschedule the session to the next available date; no refunds will be issued.
